On February 20, the 5th hearing of the trial started against the 23 communists who had been arrested and imprisoned in September 2006 in operations carried out against our party in 8 cities took place at the 10th Heavy Penalty Court of Besiktas, Istanbul.
The prisoners entered the court shouting the slogan "Start the excavations! Judge the murderers!" to draw attention to BOTAS wells in which it is predicted that the dead bodies of many disappeared people had been buried. By this, they pointed out the dirty war crimes of the counter-guerilla state which came into the open once more during the process of the Ergenekon operations. As it was during the previous hearings, the male prisoners came to the court without their shoes in order to protest the imposition on them to search their shoes.
In his defense speech, the communist prisoner Ali Hidir Polat mentioned the International Water Forum that will be held in Istanbul on March 16-22. He expressed that the goal of the forum is to sell out the water sources which is a right of the humanity to multinational companies. He said: "I believe that workers and labourers will defend their right to potable water and mobilise temselves".
The communist prisoners stated in their defence speeches that the counter-guerrilla members are not arrested despite the crimes against the humanity that they have committed have come into the open, but they have been kept in prison since two and a half years. The communist prisoner Ali Hidir Polat stated "We are charged here for our socialist ideas".
The communist prisoner Arif Celebi said: "How is crime judged? Those who own the means of production make the definition of crime. But crimes should be judged different." He said that the criterion has to be evidence and added "I do not want justice from you, but I expect you to be fair. I want that the laws are applied equal and I want justice in terms of the criterios applied." Saying this, he also reminded everybody of the blue file containing 40 printed pages obviously produced by the police itself, which are presented as "evidence". He disproved again all the accusations raised from this computer print like he did already before, demanded to find those responsible for this false evidence and that they will be tried.
The communist prisoner Ibrahim Cicek, chief editor of the newspaper Atilim greeted Muntazer Al-Zaidi, Iraqi journalist who threw his shoes to Bush.
In his defence speech made in the name of our party MLCP, Seyfi Polat made clear, that Ergenekon is the state: "Ergenekon is not even only the tip of the iceberg. Ergenekon is the state itself. The judicial machinery, trade-unions, political parties, the bureaucracy from top to bottom, traitors, civil gangs, the army and the general staff." He explained that the Ergenekon trials do not deal with the dirty war crimes committed in Kurdistan. He greeted the Saturday mothers who started their Saturday actions to find their disappeared sons and daughters once more within the context of the new evidences denounced at the Ergenekon trials. Polat greeted also the revolt in Greece and the Gaza resistance. He continued his speech with the evaluation of the economic crisis.
The court decided to release Soner Cicek and Bilgi Tagac, thus still 17 of the 23 communist prisoners are kept in prison. The next hearing of the trial will take place on June 26.

International solidarity with the prisoners continued during the 5th hearing. ASP expressed the following in the statement: "This is only one of the many trials by the Turkish regime of Ankara againstall those democratic, antifascist, communist, anti imperialist and pacifistpeople who are struggling against the violence and the crimes of thisfascist Turkish regime and its genocide against Kurdish people". ASP also criticised the support of the European imperialist states to the Turkish fascist regime. ASP called upon all the organizations which took part in the conference of Colonia 2008, to protest on the next 20thFebruary in front of the Turkish embassies all over the European countries against the fascist Turkish regime in solidarity with all the Turkish and Kurdish political prisoners.
The ASP, CARC (The Committees to Support Resistance - for Communism), SLL (Union of the Struggling Workers) and the Proletarian Communist raised their solidarity with the Turkish and Kurdish political prisoners through an action on February 20 in Napoli.
In Cologne/Germany, the Committee for Solidarity with Free Prisoners - Europe made an action at the city centre on February 20 and raised the slogan "Freedom to 10 September Prisoners".
In Ulm/Germany, the Cultural Association of Working Youth which is affiliated to the Federation of Immigrant Workers in Germany (AGIF) organised an action at the city centre while the hearing was held in Istambul. A similar action was carried out in Dusseldorf. At these actions, immediate release of the 10 September Prisoners was demanded.
